USCIS Filing Fees for Common Forms (Checked September 2026)

In Brief

This page lists the current USCIS filing fees for the forms our clients file most often. We checked every amount against the official USCIS Fee Schedule (Form G-1055, edition 09/09/26) on September 26, 2026.

Government fees change; confirm on the form’s USCIS page before filing. These are government fees, not Ozek Law’s fees.

Is a fee change scheduled for October 1, 2026?

As of September 26, 2026, we did not find a final rule or USCIS announcement that sets new fees for the forms below with an effective date on or after October 1, 2026. We checked the USCIS newsroom and the Federal Register. Points to watch:

Pub. L. 119-21 fees adjust every year

The fee schedule notes that these fees (for example the asylum fees and certain work permit and parole fees) adjust annually as required by law. USCIS announced the fiscal year 2026 adjustment in November 2025 (USCIS alerts). No fiscal year 2027 amounts had been announced when we checked.

Naturalization fees (proposed only)

DHS published a proposed rule on June 23, 2026 to adjust the Form N-400 and N-336 fees and end the reduced N-400 fee and fee waivers for both forms. It is a proposal, not a final rule, and the current N-400 fees below still apply.

H-1B cap petitions (proposed only)

DHS published a proposed rule on August 25, 2026 for an additional fee on H-1B cap-subject petitions. It is not in effect.

Already in effect

a final rule effective September 9, 2026 changed when covered H-1B and L-1 employers owe the 9-11 Response and Biometric Entry-Exit Fee. USCIS issued the 09/09/26 fee schedule edition in response.

The fee schedule also lists a $100,000 payment tied to a September 2025 presidential proclamation for certain H-1B petitions. The USCIS fee schedule page states that a federal court vacated the agency guidance implementing that payment and that DHS is complying with the order while it considers next steps, so confirm its status on the USCIS H-1B page before filing.

How to pay

USCIS no longer accepts personal checks, money orders or cashier’s checks for paper filings unless you qualify for an exemption with Form G-1651. Pay with a credit, debit or prepaid card using Form G-1450, or from a U.S. bank account using Form G-1650. Online filings are paid through Pay.gov. USCIS recommends a separate payment for each form in a package, because one defective form can cause the whole package to be rejected if a single payment covers several forms. Fees are generally not refundable. See USCIS Filing Fees for details.

How Ozek Law can help

USCIS rejects a filing that does not include the correct fee. When we prepare your case, our attorney review before filing includes checking each government fee against the current USCIS fee schedule and form page. Existing clients can make online payments and upload documents in our client portal. Our own legal fees are quoted at the consultation because every case has a different scope.

Frequently Asked Questions

USCIS Filing Fees: Frequently Asked Questions

Are these the fees Ozek Law charges?

No. Every amount on this page is a U.S. government fee paid to USCIS. Our legal fees are separate and depend on the scope of your case, so we quote them at the consultation.

Is filing online cheaper than filing on paper?

Often, yes. For many forms, including Forms I-130, I-485, I-765, I-90, I-751, N-400 and N-600, the USCIS fee schedule lists an online fee that is $50 lower than the paper fee.

How much does it cost to file a marriage-based green card case from inside the United States?

It depends on which forms you file. As of September 26, 2026, the fee schedule lists $675 (paper) for Form I-130 and $1,440 (paper) for Form I-485, plus $260 for Form I-765 while that I-485 is pending and $630 (paper) for Form I-131 if you request advance parole. Check the current USCIS fee schedule before you pay.

Is a USCIS fee change scheduled for October 1, 2026?

As of September 26, 2026, we did not find a final rule or USCIS announcement setting new fees for these forms that takes effect on or after October 1, 2026. Pending proposals are not in effect. Fees required by Pub. L. 119-21, such as the asylum fees, adjust each year, so check again before filing.

How do I pay USCIS filing fees?

Online filings are paid through Pay.gov. For paper filings, USCIS generally requires payment by credit, debit or prepaid card with Form G-1450, or by bank account (ACH) with Form G-1650. Checks and money orders are accepted only if you qualify for an exemption using Form G-1651.

Can I get a fee waiver?

Some applicants can request a fee waiver with Form I-912 for certain forms, usually with a paper filing. The fees required by Pub. L. 119-21, such as the asylum application fee and the annual asylum fee, cannot be waived.

What happens if I pay the wrong fee?

USCIS rejects an application, petition or request that is not accompanied by the correct fee. That is why the fee should be checked on the USCIS fee schedule and the form page right before filing.
