U.S. routes we compare for you

We start by comparing every realistic route against your timeline, your family and how involved you want to be in a U.S. business. The main options are:

E-2 treaty investor

(investor visas): for nationals of treaty countries who invest substantially in a U.S. business they will develop and direct. At least 50 percent of the business must be owned by treaty nationals. E-2 is a nonimmigrant visa, not a green card.

EB-5 immigrant investor

a green card route based on investment and job creation. According to the USCIS Policy Manual (checked September 26, 2026), for petitions filed on or after March 15, 2022 the minimum investment is $1,050,000, or $800,000 in a targeted employment area or infrastructure project, and these amounts automatically increase on January 1, 2027 and every five years after that. L-1 intracompany transfer

(L-1): for managers, executives and specialized-knowledge employees of a foreign company with a related U.S. entity, including a new U.S. office.

EB-1A and EB-2 NIW

(talent-based green cards): for people with extraordinary ability, or whose work has substantial merit and national importance. No U.S. job offer is required.

O-1

a temporary visa for individuals with extraordinary ability or achievement.

Many clients combine routes, for example arriving on an E-2 or L-1 while a green card petition is prepared.

Source-of-funds documentation

For investor cases, the government wants to see not only the investment but where the money came from and how it traveled to the United States. That can mean years of salary records, business sale documents, property sales, gifts, loans and bank transfers across several countries and currencies. We build a clear, documented path of funds and translate it into evidence an officer can follow. Read our E-2 source of funds guide.

Family members and children’s schooling

A spouse and unmarried children under 21 can usually be included as dependents, but each route has its own rules, and a child approaching 21 needs attention early. We plan filings with the school calendar in mind, so that children can start the school year in the right status, and we confirm what each family member’s status allows, including study and, for spouses, work authorization.

Working with your advisers

Private clients usually have a tax adviser, a banker or wealth manager, and often counsel in their home country. We coordinate with them so that the immigration plan, the investment structure and the timing of transfers fit together. Ozek Law Firm does not give tax advice: tax questions, including U.S. tax residence and reporting, go to a qualified tax adviser. When foreign law is involved, we coordinate with licensed local counsel and remain your single point of contact.

Confidentiality and discretion

Your financial and family information is protected by attorney-client confidentiality. We limit access to the attorneys and staff working on your matter, exchange documents only through our secure client portal, and share information with your other advisers only with your permission.

Long-term planning

Green card

moving from a temporary visa to permanent residence when the time is right.

Maintaining residence

long periods abroad can put permanent residence at risk. Check trips with our green card travel checker.

Re-entry permits

USCIS advises permanent residents who will be outside the United States for one year or more to apply for a re-entry permit on Form I-131; while valid, it allows you to apply for admission without a returning resident visa.

Naturalization

an absence of more than six months is presumed to break continuous residence, and an absence of one year or more breaks it unless an exception applies. See the citizenship eligibility calculator and citizenship services.

Frequently Asked Questions

Private Client Services: Frequently Asked Questions

What is the difference between E-2 and EB-5?

E-2 is a renewable nonimmigrant visa for nationals of treaty countries who invest in and direct a U.S. business. EB-5 is a green card route based on a qualifying investment and job creation, open to any nationality.

What is the current EB-5 minimum investment?

According to the USCIS Policy Manual, checked September 26, 2026, it is $1,050,000, or $800,000 in a targeted employment area or infrastructure project, for petitions filed on or after March 15, 2022. The amounts automatically increase on January 1, 2027.

Can my children come with me?

Usually. A spouse and unmarried children under 21 can generally be included as dependents, although each route has its own rules. We watch for children approaching 21.

Do you give tax advice?

No. Tax questions go to a qualified tax adviser. We coordinate with your tax adviser so that the immigration plan and the tax plan fit together.

How do you protect my financial information?

Your information is protected by attorney-client confidentiality, handled only by the team working on your matter, and exchanged through our secure client portal.

Can I keep a home abroad after getting a green card?

Yes, but long absences can affect permanent residence and naturalization. USCIS advises a re-entry permit for absences of one year or more, and we plan travel with you.

Do you work with my banker and foreign lawyer?

Yes, with your permission. We coordinate with your advisers and with licensed counsel abroad and remain your single point of contact.

How much does private client representation cost?

Scope varies, so we give a fee quote at consultation. Government filing fees are separate.
